Terms & Conditions- Warmt Family Photos


Booking Fee/Deposit
A non-refundable deposit of 200 CHF is charged for the client to secure the time and services of warmT. The remaining balance will be paid in full before Warmt provides the final digital images.

Turnaround Times
Warmt will aim to provide the client with a copy of their edited pictures via digital download within 2 weeks of the sessiondate.

Editing
All images will be edited in black and white only. All images that require it are lightly retouched (at the discretion of warmt) Specialist editing services can be provided upon request an extra fee will be charged.

Copyright Negatives/digital files
They remain the property of warmt. Images shall not, by way of trade or otherwise, be lent, resold, published for commercial purposes.


Digital files
They are supplied to the client via digital download and the client has 3months to download from the date of issue. Once the digital files are received it is the client’s responsibility to back them up and keep them safe. If the clients’ files become lost or corrupted the fee for replacement files is CFH 150 however, warmt cannot guarantee that replacement files will always be available.

License
warmt shall be granted a complete artistic license with the exception of special requests included on the client booking form. This is in relation to the poses photographed and the locations used. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.

Cancellation
The client may cancel this contract at any time by giving written notice to warmt but in doing so shall forfeit any monies paid.

Force Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.

Display
the client hereby allows WARMT to use any images included in this contract on THEIR website, IN studio, portfolio, and for exhibitions, advertising, magazine submissions, and competitions.


Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

Complaints
Any complaints should be raised by the client with warmt in writing within 28 days of receipt of the photograph.

COVID-19 RESTRICTIONS
In the instance of Government restrictions due to Covid-19 or similar, Warmt agrees to move the date of the scheduled photo shoot free of charge, waiving the cancellation policy above, and for the same rate as stated on this contract within 12 months of the original date. we adhere to all government guidelines in Switzerland for protecting our photographers and my customers against COVID-19.
